Postsecondary Regulation Changes in Ontario

Two existing regulations under the Act ( O. Reg. 280/02 – Claims Against Security, and O. Reg. 282/02 – Decisions, Orders and Appeals) would be consolidated into the existing regulation on Consents Under the Act (O. Reg. 279/02), which would also be amended to make housekeeping and consequential technical changes for better clarity; to prescribe criteria governing when the Minister of Training, Colleges and Universities may reject a consent application without a referral for a quality assurance review to improve efficiency and reduce unnecessary costs to an applicant; to establish an administrative monetary penalties regime for contraventions of the Act for effective enforcement; and to establish criteria governing when the Minister may recognize quality assurance (QA) or accrediting bodies other than the Postsecondary Education Quality Assurance Board, as currently required under the Act, for purposes of referring consent applications or for deeming prior review of such bodies to be a review under the Act.
